Privacy Statement

HermanCheckStart Development Company provides a software-based system used in connection with employment. The HermanCheckStart software program collects data for third-party licensees to be used by such third-party licensees in the employment and personnel field.

Collection of Information

While providing software-based products and services to your company, HermanCheckStart may independently obtain or receive from potential applicants and potential employers certain personal information concerning prospective applicants and employers, including nonpublic personal information, as such term is defined in Title V of the Gramm-Leach-Bliley Act and regulations promulgated pursuant to that Act, and customer information, as defined in the Interagency Guidelines Establishing Standards for Safeguarding Customer Information adopted jointly by the FDIC, FRB, OCC and OTS (collectively, "consumer information").

Use and Disclosure of Consumer Information

It is the policy of HermanCheckStart to comply with all laws and regulations concerning use and disclosure of consumer information, including the Gramm-Leach-Bliley Act and related regulations, as the foregoing apply to CHECKSTART.

HermanCheckStart limits disclosure of consumer information to its affiliates, their respective clients and to other unaffiliated third parties solely as are necessary to effect and administer services performed for our clients and licensees at their request. In addition, HermanCheckStart may disclose information pursuant to a court order, subpoena or other administrative or legal proceeding. Use of consumer information about consumers is restricted to the purposes for which such information is provided and as otherwise permitted by law.

Consultants, subcontractors or other unaffiliated third parties who are given access to consumer information in connection with software-based products of HermanCheckStart are generally required to sign confidentiality agreements restricting use and disclosure of such information to the persons who have a need to know the information in connection with the assignment, or are otherwise restricted from using the information or disclosing the information to other third parties by contractual, legal or fiduciary obligations to CHECKSTART.

Subject to the foregoing statements, HermanCheckStart does not currently have any arrangements for or agreements with unaffiliated entities which would permit access to or sharing of consumer information by HermanCheckStart with a third party, other than the prospective employers and licensees referenced above. In addition, at this time, HermanCheckStart does not sell consumer information to third parties and has no plans to do so.
HermanCheckStart reserves the right to use the information and responses provided to improve the quality of its software product.
